Delhi Police Deny Arresting Mamata Banerjee During Protests
Delhi Police asked the Supreme Court of India to dismiss a habeas corpus petition, stating Trinamool Congress leaders were removed from a protest site but not arrested.
The Delhi Police informed the Supreme Court of India that Trinamool Congress leaders, including Mamata Banerjee, Derek O'Brien, and Dola Sen, were not detained or arrested during protests in New Delhi on October 10. In a counter-affidavit, Joint Commissioner of Police Surender Kumar stated that the leaders were removed from South Avenue for violating directions issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita.
Police reported that the leaders were transported to Dwarka North Police Station, where they received food and amenities before being released between 5:50 pm and 6:05 pm. The agency has urged the court to dismiss the habeas corpus petition filed by advocate Dr. Maneka Guruswamy.
The Delhi Police argued that the plea is now infructuous because no preventive detention or arrest took place during the encounter.
