DWP Refunds 197 Claimants After Incorrect Benefit Penalties

The Department for Work and Pensions is refunding 197 benefit claimants who were incorrectly issued Administrative Penalties between 2023 and 2025. The department identified 128 cases from 2023/24 and 69 from 2024/25 where penalties, ranging from £350 to £5,000, were applied without sufficient evidence for conviction or a full consideration of case circumstances.

These errors affected approximately 23 percent of claimants who accepted penalties during that period. To prevent future occurrences, the department has implemented new investigator guidance and established an independent decision-making panel. While the penalties are being rescinded, affected individuals remain responsible for repaying any outstanding benefit overpayments.

This correction comes as the government pursues a goal to save £14.6 billion over five years by tackling benefit debts. This strategy includes the introduction of new powers in October that will require banks to share financial data and allow the government to deduct funds directly from accounts. Big Brother Watch criticized these measures, claiming they would usher in an unprecedented system of mass financial surveillance.
