South Africa Files ICJ Dossier Alleging Israeli Non-Compliance

The Government of South Africa submitted a dossier to the International Court of Justice on August 25, 2026, alleging that Israel has failed to comply with three binding provisional orders intended to protect Palestinians in Gaza. Filed under Article 11 of the court's Resolution concerning Internal Judicial Practice, the submission provides evidence to a three-judge committee tasked with monitoring compliance and recommending actions to the full court.

South Africa asserts that Israel's failure to adhere to these measures undermines the administration of justice and threatens Palestinian lives. The South African Foreign Ministry reported that an average of one Palestinian child has been killed daily by Israeli forces since a ceasefire was announced in October 2025. These developments stem from a case originally filed by South Africa on December 29, 2023, which accuses Israel of violating the 1948 Genocide Convention.

Israel rejects the genocide allegations, maintaining that its military operations target Hamas and other armed groups while adhering to international law. While the court issued provisional measures in early and mid-2024 to prevent prohibited acts and facilitate humanitarian aid, it has not yet ruled on the merits of the case. Written arguments are scheduled to continue through May 2029.
