Trump Administration Reverses Biden-Era Transgender Policies
The Trump administration implemented executive orders defining sex as binary and restricting public funding for transgender surgeries while facing Senate opposition.
The Trump administration has enacted a series of executive orders and regulatory actions to dismantle transgender-related policies established under the Biden administration. These measures define sex as strictly binary, remove the X gender option from passports, and restrict public funding for transitioning surgeries. The administration also overturned Title IX interpretations, allowing schools to restrict bathrooms and locker rooms by biological sex, and filed lawsuits against states that permit males to compete in women's sports.
Legislative efforts to further these goals have met mixed results. While the House of Representatives passed measures to block federal funding for minors' transgender surgeries and prohibit schools from recording gender transitions without parental consent, Democrats in the Senate used the filibuster to block these initiatives.
Judicial action has also played a role in the shift. In March 2026, the Supreme Court of the United States issued an emergency ruling enjoining California policies that allowed schools to withhold notification from parents regarding a child's gender transition. This ruling countered arguments from the American Federation of Teachers and the Committee of Ten, which had defended the privacy interests of students over parental rights.
