China Imposes 20% Tax on Offshore Trust Assets

China's Ministry of Finance and tax authority imposed a 20% levy on offshore trusts to raise revenue amid an economic slump.

The Ministry of Finance of the People's Republic of China and the State Administration of Taxation issued rules on July 24, 2026, imposing a 20% levy on offshore trusts. The tax applies to nearly every stage of the trust lifecycle, including establishment, profit distribution, and termination.

This measure targets ultra-wealthy individuals who utilize offshore structures in financial hubs such as Hong Kong and Singapore to hold assets. The government has established a retrospective window, requiring individuals to declare and pay taxes on assets transferred into these trusts since the beginning of 2023. Taxpayers have a 90-day grace period to comply, with a deadline set for October 22.

Officials introduced the levy to generate fiscal revenue following a broader economic downturn and a collapse in land sales. The retrospective requirement has triggered a scramble for liquidity among investors. Market analysts suggest this may lead to forced stake reductions or episodic selling pressure as investors liquidate A-share holdings and assets in Hong Kong to fund their tax obligations.
