The investigation is currently in the final stages of preparing a potential lawsuit. Any resulting settlement or legal action would require approval from Republican commissioners Andrew Ferguson and Mark Meador. The inquiry follows a February 2025 request for public input regarding the demonetization or banning of posts based on user affiliations.
FTC Chair Andrew Ferguson has advocated for holding platforms accountable for the representations they make to consumers regarding speech policies. While the FTC has declined to confirm the specific investigation and YouTube has declined to comment, the agency has previously stated that leaks will not hinder its law-enforcement investigations or litigation.
