Lawyer Challenges Manchester Airport Parking Fine Legality
Lawyer Nick Freeman argues that Manchester Airport cannot legally recover parking fines from vehicle keepers due to the airport's governance by bylaws.
Lawyer Nick Freeman, known as 'Mr Loophole,' is challenging the legality of the £100 late payment charges imposed by Manchester Airport's barrierless parking system. Under this system, motorists must pay at least £5.50 online by midnight the following day or face a £100 fine, which is reduced to £60 if settled within 14 days.
Freeman argues that because the airport is governed by bylaws, it likely does not qualify as relevant land under the Protection of Freedoms Act 2012. He contends that this means parking operators cannot legally pursue a registered vehicle keeper for payment unless the specific driver is identified.
Manchester Airport officials maintain the fines are enforceable and has contracted the company APCOA for enforcement, though the airport declined to comment specifically on the legal challenge. APCOA stated it is a member of the British Parking Association Approved Operator Scheme, where its processes have been audited and approved.
