US State Department Proposes Major J-1 Visa Overhaul

The US Department of State proposed a major overhaul of regulations for J-1 exchange visitor visas to strengthen program integrity and improve oversight. Published in the US Federal Register, the draft rule seeks to tighten legal status maintenance and expand the grounds for terminating participation, specifically citing fraud, criminal conduct, and national security concerns.

The proposal codifies the reinstatement process for those who lose their status and increases compliance burdens for sponsoring entities. Universities, research institutions, and teaching hospitals would be required to implement closer monitoring of visitors and maintain updated records in the Student and Exchange Visitor Information System.

These changes follow a recent shift from a duration of status system to fixed admission periods of up to four years. The proposal is open for public comment for 60 days and is expected to impact thousands of Indian nationals, including doctors, scientists, and postdoctoral researchers.
