Justice Ketanji Brown Jackson Criticizes Supreme Court Emergency Docket

Supreme Court Justice Ketanji Brown Jackson criticized the court's increasing reliance on its emergency docket, often called the shadow docket, during a lecture Thursday at the University of the District of Columbia David A. Clarke School of Law. Jackson argued that fast-tracking high-profile, politically contentious cases without oral arguments or clear explanations has a potentially corrosive effect on the federal court system.

Jackson specifically highlighted the Trump administration's frequent use of the docket to bypass standard review processes and stay lower-court rulings. She cited examples such as the rapid deportation of immigrants to third-party countries, the cancellation of NIH research grants, and the expansion of immigration agents' discretion. Jackson compared the inconsistent application of these orders to Calvinball jurisprudence and questioned why one party should receive a fast pass to the court while others remain queued.

While acknowledging that the court has recently provided more reasoning in its emergency decisions, Jackson urged her colleagues to return to first principles. She argued that the court should limit emergency interventions to cases where significant harm is imminent to avoid divesting lower courts of their authority and steering the judiciary into the political fray.
