Democrats Hold Shadow Hearing Over Fatal ICE Shooting in Maine

Democratic members of Congress and Maine officials held a shadow hearing on August 18 at Biddeford High School to investigate the July 13 fatal shooting of Johan Sebastián Durán Guerrero. The 25-year-old Colombian national, who had a pending asylum case and valid work authorization, was shot by a U.S. Immigration and Customs Enforcement (ICE) officer during a traffic stop in Biddeford, Maine.

During the hearing, Representative Chellie Pingree and House Democratic Whip Katherine Clark alleged the stop was random and lacked legal justification. They asserted that Durán Guerrero was not the intended target of the operation, but rather his roommate, who they claim did not have a final removal order. In contrast, the U.S. Department of Homeland Security defended the shooting as an act of self-defense, stating an agent opened fire after Durán Guerrero veered his car toward an officer.

Governor Janet Mills called for the fundamental reform or abolition of ICE, proposing that agents be required to wear body cameras and identify themselves. The incident is one of at least nine deaths involving ICE agents since Donald Trump began his second term. While President Trump opposed a temporary suspension of most ICE vehicle stops following the event, Maine Attorney General Aaron Frey is investigating whether state law allows for legal action against the federal agents. The investigation also includes scrutiny of the officer involved, who reportedly has a history of violent behavior and mental health issues.
