The cannabis industry remains largely barred from television advertising due to a conflict between state and federal laws. While 24 U.S. states have legalized recreational marijuana, the lack of federal legalization means broadcasters operating under federal licenses typically refuse to air cannabis commercials to avoid regulatory risks.
In states where advertising is permitted, strict local guidelines further limit the scope of campaigns. The New York State Office of Cannabis Management prohibits the depiction of product consumption and enforces rules ensuring that marketing does not appeal to individuals under 21.
Most retailers are small, stand-alone operations without the budget for large-scale media buys. However, larger retail chains such as FlynnStoned, which operates 13 stores in New York, are positioned to enter these channels if federal or state regulations loosen.
