UK Government Ends Compensation Penalty for Asbestos Victims' Families
The Department for Work and Pensions eliminated a payout disparity for bereaved families of workers who died from asbestos-related diseases.
The Department for Work and Pensions announced a policy change on October 31, 2026, to eliminate a compensation disparity for families of workers who died from asbestos-related diseases before filing a claim. Under previous rules, bereaved dependants received an average payment of approximately £10,700, significantly lower than the £17,700 average received by sufferers.
Under the new regulations, dependants will receive the full award. For a 60-year-old claimant diagnosed with diffuse mesothelioma, the maximum lump sum increases from £24,526 to £56,656. The reform applies to new claims made from October 31, 2026, but is not retrospective. Similar changes are expected in Northern Ireland through the Department for Communities.
The decision follows decades of lobbying by the Asbestos Victims Support Group Forum UK and various parliamentarians. Government officials characterized the previous system as an injustice, noting that families should not face financial penalties due to the loss of a loved one. The Health and Safety Executive highlighted that the effects of past asbestos exposure continue to cause suffering for workers and their families.
