The 8th US Circuit Court of Appeals blocked the enforcement of Minnesota's first-in-the-nation law banning AI-generated fake nude images. The ruling grants an injunction requested by xAI, reversing a previous decision by US District Judge Donovan W. Frank, who had rejected the company's bid to stop the law.

Enacted on August 1, the Minnesota law prohibits software developers and website operators from allowing users to create realistic images of intimate body parts that were not present in original photos of identifiable individuals. Minnesota officials defended the measure as a necessary tool to combat the generation of child sexual abuse material.

xAI argues the law is unconstitutional and restricts free speech. The company maintains that its Grok Imagine tool already employs rigorous protections against sexualized images and has begun suing users who attempt to evade those technological blockers.
