U.S. District Judge Rita Lin dismissed Elon Musk's xAI trade secret lawsuit against OpenAI with prejudice, ruling the company failed to prove misappropriation of Grok chatbot data.

U.S. District Judge Rita Lin dismissed a trade secret lawsuit filed by Elon Musk's artificial intelligence company, xAI, against OpenAI on June 15, 2026. The court ruled that xAI failed to prove OpenAI induced former senior engineer Xuechen Li to divulge confidential information regarding the Grok chatbot or that OpenAI engineers were aware of any such disclosure. Judge Lin dismissed the case with prejudice, stating that inquiring about a candidate's past work during recruitment is routine and that further attempts to amend the complaint would be futile.

This ruling marks the second legal defeat for Musk against OpenAI in four weeks. On May 18, a federal jury rejected a $150 billion lawsuit in which Musk claimed OpenAI betrayed its original nonprofit mission. While Musk has indicated intentions to appeal that ruling and is pursuing a separate antitrust case against OpenAI and Microsoft, OpenAI has characterized his legal actions as a baseless campaign of harassment.

Amidst these legal battles, OpenAI has confidentially filed for an initial public offering in the United States with a valuation exceeding $850 billion. Although the trade secret case is closed, xAI continues to pursue separate legal action against Xuechen Li.
