Electoral Court Dismisses MK Party Challenge to 2024 Election
The Electoral Court rejected the uMkhonto weSizwe Party's application to set aside South Africa's 2024 election results, ruling the claims of vote manipulation were flawed.
The Electoral Court dismissed an application by the uMkhonto weSizwe (MK) Party to set aside the results of South Africa's 2024 national and provincial elections. The MK Party alleged that the Electoral Commission of South Africa's digital vote-capturing system was unreliable, claiming a two-hour leaderboard blackout on May 31, 2024, allowed for the manipulation of over 9.3 million votes.
The court ruled the case was flawed and based on inferences rather than sound evidence. Judges noted that audit trails proved results continued to be captured and edited during the technical glitch. Furthermore, the court found the application was not competent in law because the MK Party failed to follow mandatory objection procedures required under the Electoral Act.
The Electoral Commission of South Africa welcomed the ruling. The commission announced it will now finalize an independent and external audit of the result system to be used for the upcoming election on November 4, 2026.
