Nebraska Secretary of State Removes Cindy Burbank From Senate Ballot

Nebraska Secretary of State Bob Evnen officially removed Democratic nominee Cindy Burbank from the November 3 general election ballot for U.S. Senate. The action follows Burbank's submission of a form to decline her nomination, a move she stated was based on reviewing the numbers and deciding not to seek the seat. Her withdrawal is intended to unify opposition votes behind independent candidate Dan Osborn against Republican incumbent Pete Ricketts.

Evnen characterized the withdrawal as a cynical manipulation of the ballot process. He noted that he had previously attempted to block Burbank from the primary ballot earlier in the year, though the Supreme Court of Nebraska overruled that decision in March. Despite his criticism, Evnen stated that under state law, he has no discretion to refuse a nomination once a candidate has declined it by the deadline.

The Nebraska Democratic Party now has until September 1 to identify a substitute candidate and pay a $1,740 filing fee to maintain a presence on the ballot. Party chairwoman Jane Kleeb expressed support for Osborn, suggesting a coalition of Democrats and independents could break one-party rule. Conversely, the campaign of Pete Ricketts and the National Republican Senatorial Committee claimed Osborn has rigged the ballot and is effectively the Democratic nominee.
