Judge Lamberth Considers Sanctions Over Transgender Inmate Housing

U.S. District Judge Royce Lamberth is considering sanctions against the Trump administration for allegedly violating a May court order concerning the housing of transgender women in federal custody. The administration moved transgender women into segregated housing units, a move that attorneys for the inmates describe as a backdoor attempt to implement an executive order.

Legal representatives for the inmates argue that segregated housing violates the spirit of the injunction by causing emotional distress and exacerbating gender dysphoria. The U.S. Department of Justice maintains that no violation occurred, asserting that the original order prohibited only transfers to men's facilities and did not mandate placement within the general population of women's facilities.

The case is proceeding as a class-action lawsuit. A ruling could establish a nationwide precedent for the treatment of transgender inmates and their protections under the Prison Rape Elimination Act of 2003.
