Delhi High Court Rejects Petition to Deport Illegal Migrants

The Delhi High Court dismissed a petition filed by MA Burney that sought a broad mandate for authorities to identify and deport alleged illegal migrants from Bangladesh and the Rohingya community. The petition targeted several specific areas, including Shaheen Bagh, Batla House, Majnu Ka Tila, Kalindi Kunj, Shram Vihar, and Taimur Nagar.

Justice Purushaindra Kumar Kaurav ruled that the plea relied on vague and unsubstantiated allegations that lacked prima facie evidence. The court determined that issuing such a direction would result in an impermissible "fishing and roving enquiry" that exceeds the scope of writ jurisdiction.

Supporting evidence showed that the petitioner had not filed formal complaints with the Sarita Vihar Police Station nor provided a list of specific individuals for investigation. Furthermore, a police inquiry conducted in the mentioned neighborhoods found no illegal migrants. The court concluded the proceedings by noting that the deportation of foreign nationals remains within the exclusive domain of the executive.
