Debt Collectors Revive Subprime Zombie Mortgages From 2000s Boom

Debt collectors are reviving dormant second mortgages from the early 2000s housing boom, a practice known as "zombie" mortgages. These loans were typically subprime 80/20 products where the second mortgage covered 20% of a home's purchase price. Following the 2007 market crash, many lenders ceased collection efforts because plummeting home values eliminated the equity needed to make recovery profitable.

Recent pandemic-driven increases in home values have shifted the economic landscape, making these old debts profitable for collectors once more. Collectors are now demanding outstanding balances, fees, and interest, with some threatening foreclosure. Andrea Bopp Stark, a senior attorney at the National Consumer Law Center, described the situation as "shocking, traumatic and devastating," noting that these subprime loans often featured high or rapidly adjusting interest rates that made them unsustainable for homeowners.

In response, the National Consumer Law Center has urged the Consumer Financial Protection Bureau to establish a national database to help borrowers identify these dormant loans. Legal experts warn that homeowners should verify all debts and consult professionals before making payments, as even small payments can restart the statute of limitations clock in certain states. The Consumer Financial Protection Bureau and the U.S. Department of Housing and Urban Development provide validation guidelines and certified free housing counselors to assist affected homeowners.
