William Forbes Sues Nebraska Democrats to Force Senate Nominee Replacement

Former Democratic U.S. Senate primary candidate William Forbes filed a lawsuit in Lancaster County District Court to compel the Nebraska Democratic Party to replace nominee Cindy Burbank. The legal action follows Burbank's withdrawal from the race last week, which occurred shortly after signatures were verified for nonpartisan candidate Dan Osborn.

Forbes argues that state law requires the party to fill the ballot vacancy to prevent voters from being disenfranchised. This conflict emerges amid a volatile primary cycle; Secretary of State Bob Evnen previously attempted to remove Burbank from the ballot, though the state Supreme Court overturned that effort.

The Nebraska Democratic Party has not recruited a replacement candidate. Party chair Jane Kleeb has instead endorsed Dan Osborn. A court hearing for the lawsuit is scheduled for July 29, with the legal deadline for replacing the nominee set for September 1 ahead of the general election on November 3.
