Paul Goldsmith Introduces Expanded Citizen Arrest Powers in NZ

Justice Minister Paul Goldsmith announced that the Crimes Act Amendment Bill is scheduled for its final reading this week. The legislation introduces expanded powers for citizens and businesses to detain and arrest offenders, specifically removing previous time restrictions on intervening in Crimes Act offences such as theft under $1,000, which were once limited to the hours between 9 PM and 6 AM.

The bill clarifies that reasonable force and restraints may be used during arrests, provided the person contacts the police and follows their instructions. Beyond citizen arrests, the overhaul establishes specific new offences for assaulting first responders and front-line corrections workers, creates three new coward punch offences, and introduces a shoplifting infringement regime.

Additionally, the bill strengthens laws against people smuggling and human trafficking. The legislation is expected to take effect within one week of passing into law, fulfilling commitments made by the coalition partners to increase penalties for retail crime and violence.
