USCIS More Than Doubles EB-5 Immigrant Investor Fees

U.S. Citizenship and Immigration Services is substantially increasing fees for the EB-5 Immigrant Investor Program effective November 30, 2026, to cover administrative and fraud detection costs.

The United States Citizenship and Immigration Services finalized a rule on September 29, 2026, to significantly increase fees for the EB-5 Immigrant Investor Program. Effective November 30, 2026, the new structure more than doubles several costs, including the Form I-526 filing fee for standalone investors, which rises from $3,675 to $7,615, and the Form I-526E fee for regional center investors, which increases to $7,850. The Form I-829 fee for removing conditions on permanent residency will also increase to $5,000.

Regional centers face the sharpest increases, with Form I-956 designation fees jumping from $17,795 to $44,115, although the annual Form I-956G fee will decrease to $2,165. These revisions follow the EB-5 Reform and Integrity Act of 2022, which mandated a cost study to ensure the agency recovers full expenses for audits, background checks, and fraud detection.

USCIS stated the hikes are necessary because the agency is funded primarily by fees rather than taxes. While the administrative costs are rising, the statutory investment requirements for the program remain unchanged, generally ranging from $800,000 to $1.05 million. The increases are expected to particularly impact Indian entrepreneurs and families who already face significant Green Card backlogs.
