Lalit Modi Plans India Return After Tribunal Quashes Penalties

An appellate tribunal under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act has overturned the majority of the Enforcement Directorate's findings against Lalit Modi and the Board of Control for Cricket in India. The ruling resolves a decade-old dispute concerning alleged violations of the Foreign Exchange Management Act during the 2009 IPL season in South Africa. The tribunal rejected the agency's core argument that remittances of approximately $49.86 million to Cricket South Africa were capital account transactions requiring Reserve Bank of India approval, instead classifying them as current account transactions for hosting services.

The tribunal exonerated Modi, ruling that the penalties against him were wholly erroneous as he was not legally in charge of the board's affairs. While the board was cleared of the primary charge, the tribunal upheld a 4 crore rupee penalty for an unjustified excess remittance and a reduced 1 crore rupee penalty for delaying the repatriation of ticket revenue.

Following the verdict, Modi announced plans to return to India late this year or early next year, coinciding with the birth of his grandchild in October. Having lived in London since 2010 and recently acquiring Vanuatu citizenship, Modi stated he has no intention of returning to cricket administration. He previously maintained that he fled India due to life threats from Dawood Ibrahim.
