Ohio House Introduces Bill to Regulate Data Center Growth

Members of the Ohio House of Representatives introduced House Bill 983 to regulate the rapid expansion of data center development across the state. The proposed legislation would mandate voter approval for any new construction or expansion of data centers with a peak electric load exceeding one megawatt. This requirement would apply to all municipalities and townships within five miles of a project site.

The bill aims to restrict local governments from offering property tax incentives for data centers and associated power plants. It also requires the public disclosure of all development and supply agreements. To address environmental concerns, the legislation introduces new air emission and water discharge standards for substances including PFAS and glycols, while holding owners financially responsible for impacts on water supply and pressure.

Proponents of the bill state the measures are necessary to protect public utilities and state finances. However, critics argue that the voter approval mandate could function as a de facto ban on the industry, potentially costing the state tens of billions of dollars in planned investments.
