Trump Administration Appeals Court Order to Remove Tariffs

The Trump administration is appealing a ruling by the Court of International Trade that ordered the removal of sweeping tariffs imposed under Section 122 of the Trade Act of 1974. The court previously rejected the administration's original legal theory, prompting the government to introduce a new justification based on basic balance, an economic statistic the federal government abandoned in 1976 because it was unreliable.

In the case of Burlap and Barrel v. Trump, the administration has requested that the court block all refunds to affected American businesses until the appeals process is fully exhausted. The matter is now before the Court of Appeals.
