Abuja Court Rules Nigerian Voters Can Challenge INEC Results

Judge Peter Kekemeke ruled that Nigerian voters have the legal standing to hold the Independent National Electoral Commission accountable for inaccurate election results.

A Federal Capital Territory High Court in Maitama, Abuja, ruled that Nigerian voters possess the legal standing to challenge election results transmitted by the Independent National Electoral Commission (INEC). Judge Peter Kekemeke issued the ruling after dismissing a preliminary objection filed by INEC in a lawsuit brought by voter Ephraim Okoye.

Okoye alleges that during the 2023 presidential election, INEC failed to transmit the actual results from his polling unit at Finance Quarters 1 in Wuye, uploading false data to its server instead. The claimant is seeking a court order to delete the inaccurate results, publish the correct form EC8A, and receive damages between N50 million and N150 million for distress and wasted time.

In his decision, Kekemeke affirmed that the judiciary must demand accountability from government agencies to protect the sanctity of the electoral system. The court has adjourned the case until September 24 for further hearing.
