Trump Administration Restricts H-1B and L-1 Visa Extensions

The Department of Homeland Security is eliminating automatic work permit extensions and proposing stricter vetting for H-1B and L-1 visa renewals.

The Department of Homeland Security is implementing two restrictive measures targeting skilled foreign workers and their dependents. The agency, alongside U.S. Citizenship and Immigration Services, proposed the elimination of a policy allowing H-1B and L-1 visa holders to receive extensions based on previously approved petitions. This change is subject to a 30-day public comment period.

Officials argue the move is necessary to combat fraud and noncompliance, noting that fraud rates for H-1B extensions rose to 22.39% between 2022 and 2025. Simultaneously, the agency finalized a rule that immediately ends automatic work permit extensions for certain foreign nationals, including H-4 spouses of H-1B workers. These individuals previously received extensions of up to 540 days while awaiting renewal.

Critics warn the restrictions will lead to employment gaps, lost income, and housing instability, particularly for women. The Department of Homeland Security estimates the changes could result in $312.1 million in labor turnover costs.
