Rand Paul Proposes 28th Amendment to End Birthright Citizenship

Rand Paul, a U.S. Senator from Kentucky, reintroduced a joint resolution proposing a 28th Amendment to the U.S. Constitution to eliminate birthright citizenship. The proposal seeks to redefine the phrase subject to the jurisdiction of the United States within the 14th Amendment.

Under the proposed language, individuals born in the U.S. would only be granted citizenship if at least one parent is a U.S. citizen, a national, a lawful permanent resident, or an alien with lawful status serving in the Armed Forces. This legislative move follows the legal decision in Trump v. Barbara, which supporters claim shifts the birthright citizenship debate from the judicial system to the national public.

To become law, the resolution requires ratification by the legislatures of three-fourths of the states within a seven-year window.
