New York Enacts Data Center Moratorium Amid Maine Regulatory Push

Legislative efforts to curb the environmental impact of data centers are expanding across the Northeast. The New York State Legislature enacted a one-year moratorium and a suite of new regulations requiring aggressive environmental reviews and on-site renewable energy generation, starting at 33% by 2030. Governor Kathy Hochul and the bill's authors support the measure to ensure data centers fund their own infrastructure rather than shifting costs to ratepayers.

These regulations have faced pushback from industry advocates. Daniel Ortega of New Yorkers for Affordable Energy argued that excluding nuclear and natural gas from the mandates threatens energy reliability and may drive business to states like Texas, Virginia, and Georgia.

Parallel advocacy is occurring in Maine, where resident Mark Love called for the state to implement stricter development laws. Love proposed legislation that would require data center developers to install renewable energy capacity equivalent to their total consumption and utilize geothermal technologies instead of groundwater extraction for cooling. He argued that current operational costs are being shifted from corporations to the public through excessive electricity and water use.
