German States Propose 20 Percent Social Media Content Quota

German federal states propose requiring social media platforms to reserve 20 percent of algorithmic recommendations for state-approved media outlets to promote opinion diversity.

The Broadcasting Commission of the Federal States has developed a draft Digital Media State Treaty that would require social media platforms, including X and Instagram, to reserve at least 20 percent of algorithmic recommendations for content from a pool of state-approved media outlets.

The proposal aims to protect journalistic content from being sidelined by engagement-driven material and to promote opinion diversity. Under the draft, public broadcasters such as ARD, ZDF, and Deutschland Radio would qualify for the pool automatically. Private media outlets would be required to apply to 14 state media authorities and meet specific editorial and reporting standards to be included.

Critics have characterized the measure as a state-mandated propaganda effort intended to secure control over online discourse and provide an unfair advantage to state-funded broadcasters. The draft was released for public consultation in late September 2026, with a submission deadline of November 13. For the measure to take effect, it requires agreement and ratification by the parliaments of all 16 German states.
