Oracle Corporation Sues Wisconsin Regulators Over Data Center Credit Rules

Oracle Corporation filed a lawsuit in Ozaukee County Circuit Court on June 19 against the Public Service Commission of Wisconsin. The company is challenging a regulatory decision from April that mandates data center developers maintain an A- credit rating from Standard & Poor’s or an A3 rating from Moody’s to avoid posting cash deposits or letters of credit.

Because Oracle Corporation holds a BBB credit rating, its subsidiary faces annual costs exceeding $100 million to secure service for the $15 billion Lighthouse campus in Port Washington. The company argues the commission exceeded its legislative authority and that these stringent requirements will deter future investment in the state.

We Energies, the utility provider for the project, supports Oracle Corporation's challenge, stating the mandates remove flexibility and increase costs. In contrast, the Citizens Utility Board and Clean Wisconsin support the commission's rules, claiming they are necessary to protect ratepayers from risks linked to massive AI-driven energy consumption.
