Elizabeth Warren Questions McDonald's Over AI Pricing Tools

Senator Elizabeth Warren and Democratic lawmakers are questioning McDonald's over allegations that AI algorithms are used to inflate menu prices and facilitate franchisee collusion.

US Senator Elizabeth Warren and four Democratic Representatives sent a formal letter to McDonald's CEO Chris Kempczinski on November 2, questioning the company's use of machine learning algorithms to determine optimal price recommendations for menu items. The lawmakers expressed concern that these AI tools could be used to inflate consumer prices or facilitate illegal collusion among franchisees who should be operating as competitors.

In the letter, the lawmakers requested clarification by November 16 regarding whether the tools utilize individual loyalty program data and what antitrust reviews were conducted before deployment. This legislative inquiry follows two consumer class action lawsuits alleging that the company illegally coordinates prices through a centralized algorithmic system.

McDonald's has denied that AI sets menu prices, characterizing reports of these practices as speculative and uninformed. The company stated that its pricing tools are not a mandate and that franchisees maintain autonomy over their pricing decisions.
