India Grants Government Power to Regulate Airline Ticket Prices

The Government of India notified new aviation rules allowing temporary intervention in ticket pricing during extraordinary situations to protect the public interest.

The Government of India has notified the Bharatiya Vayuyan Niyam 2026, a new regulatory framework that grants the central government authority to intervene in airline ticket pricing during extraordinary situations in the public interest. Set to take effect on January 1, 2027, these rules replace the Aircraft Rules of 1937 and come amid concerns over high airfares driven by elevated crude oil and Aviation Turbine Fuel prices.

Under the new regulations, airlines must determine fares based on operational costs and submit tariff details to the Directorate General of Civil Aviation. While India has maintained deregulated fares since 1994, the government can now issue proportionate, time-bound written directions on pricing. However, the rules do not establish a permanent price cap, and the framework does not explicitly list predatory pricing or oligopolistic practices as grounds for intervention.

The regulations also mandate full transparency, requiring airlines to provide an itemized breakdown of base fares, taxes, fees, and cancellation charges on tickets and digital booking platforms. This notification follows Supreme Court of India proceedings regarding allegations of excessive airfares, where Solicitor General Tushar Mehta informed the court that the rules had received administrative approval. The court has requested the final notified rules by November 16.
