Delhi High Court Issues Notice to OpenAI in ANI Copyright Appeal

The Delhi High Court has issued a notice to OpenAI seeking a response to an appeal filed by the news agency Asian News International (ANI). The appeal challenges a previous single-judge ruling that denied interim relief in a copyright infringement lawsuit.

ANI alleges that OpenAI used its content without authorization to train and operate ChatGPT. The news agency is seeking an injunction to prevent the company from storing, publishing, or reproducing its copyrighted material. ANI argues that Indian law adheres to fair dealing rather than fair use and cites OpenAI's licensing agreements with other publishers as evidence that a market for such content exists.

Justice Amit Bansal previously denied the interim relief, stating that OpenAI's use of the material did not appear to be copyright infringement. The judge further noted that an injunction would harm AI development and the public interest. The Broadband India Forum has sought to intervene in the proceedings, citing the global implications of the case. The court has scheduled the next hearing for December 5.
