India Supreme Court to Hear Mamata Banerjee Symbol Dispute

The Supreme Court of India agreed on September 21 to list a petition filed by former West Bengal Chief Minister Mamata Banerjee. The legal challenge targets an interim decision by the Election Commission of India to freeze the name and 'Flowers & Grass' symbol of the All India Trinamool Congress.

The dispute stems from a leadership conflict between factions led by Mamata Banerjee and Leader of Opposition Ritabrata Banerjee. The freeze occurs immediately before the October 6 Assembly by-elections in Nandigram and Rejinagar. Under the current interim rules, the Mamata Banerjee faction must operate as the 'Mamata All India Trinamool Congress' using a 'Football Player' symbol, while the Ritabrata Banerjee faction uses the name 'Democratic Trinamool Congress' and an 'Envelope' symbol.

Counsel Kapil Sibal requested an urgent hearing and a stay on the order, arguing that the Election Commission acted improperly by freezing the symbol after the by-election notification had already been issued. Chief Justice Surya Kant directed that the matter be listed for hearing.
