FSSAI Files Three Adjudication Cases Against Nestlé India

The Food Safety and Standards Authority of India (FSSAI) filed three separate adjudication cases against Nestlé India Ltd on September 18 for violating food safety and promotional regulations. The regulator identified prohibited promotional claims on e-commerce platforms for NAN Excella Pro Stage 1 and Lactogen Pro 1, specifically regarding the digestibility of whey protein and the presence of five HMOs.

These claims contravene the IMS Act of 1992 and the FSS (Foods for Infant Nutrition) Regulations of 2020. In a separate quality issue, laboratory testing and referral analysis determined that a Nestlé India follow-up formula was sub-standard because it contained lower-than-prescribed levels of Biotin.

Following the announcement of the legal actions, Nestlé India shares experienced an intraday decline between 1.82% and 3%.
