India Government Seeks to Quash Student Protest Cases

The Government of India filed a petition in the Supreme Court of India seeking to quash First Information Reports registered against students who participated in protests in New Delhi and several other states. Solicitor General Tushar Mehta presented the application to the court, which agreed to hear the matter on September 1 before a bench led by Chief Justice Suryakant.

To facilitate the withdrawal of these cases, the Supreme Court indicated it may invoke Article 142 of the Constitution. This special power would allow the court to bypass standard legal hurdles that typically require a report to be submitted to a magistrate for the dismissal of an FIR. By using these extraordinary powers, the court intends to streamline the process of removing the legal charges against the student protestors.
