Justice Family Seeks Extension for Greenbrier Refinancing Deal

The family of Governor Jim Justice requested a court extension to finalize a $500 million refinancing deal for The Greenbrier to avoid federal receivership.

The family of Governor Jim Justice has requested an extension until August 7, 2026, to finalize a $500 million refinancing agreement with New York-based Kennedy Lewis Investment Management. This move follows a missed July 16 deadline and an order from Chief U.S. District Judge Frank W. Volk requiring the family to explain why the court should not proceed with a ruling on placing The Greenbrier resort into federal receivership.

White Sulphur Springs Holdings, a subsidiary of TRT Holdings and affiliate of Omni Hotels & Resorts, is suing the Justice family after loans went into default. While the Justice family proposed a $320 million settlement, White Sulphur Springs Holdings is demanding a full payoff of approximately $387.7 million and seeking the appointment of a receiver to take control of the property. The Justice family has accused the creditor of extortion and attempting to sabotage the refinancing deal to seize the resort.

Closing the deal remains complicated by regulatory hurdles and additional claims. Acting Director David Bradley of the West Virginia Lottery Commission has raised concerns regarding the resort's financial integrity and debt load. Furthermore, the West Virginia State Tax Division, Fivemile Energy, and New London Tobacco Market have filed motions to intervene as judgment creditors to ensure outstanding liabilities are addressed.
