Emily Moreno filed a federal lawsuit in Ohio against her ex-husband, Max Miller, a U.S. Representative, and his attorney, Aaron Minc. The suit follows the publication of a nude photograph of the couple's two-year-old daughter in a Dropbox folder shared on X. The folder was intended to provide evidence defending Miller against Moreno's allegations of domestic abuse following an August 2 livestream.

The image remained publicly accessible for approximately 23 hours and received over 400,000 interactions before its removal. Moreno is seeking $150,000 in damages for every instance the image was accessed or downloaded. Attorney Aaron Minc has accepted sole responsibility for the incident, characterizing the inclusion of the photo as an unintentional mistake.

Representative Miller denied any intent to publish the image but has refused to withdraw from his re-election race in Ohio's 7th Congressional District. The incident prompted Senator Bernie Moreno to call for Miller's resignation. Simultaneously, the House Ethics Committee opened an investigation into Miller's conduct, which includes separate allegations of illegal drug use.
