The United States Environmental Protection Agency announced new rules on January 16, 2026, requiring large power generators at data centers to comply with Clean Air Act regulations. The policy mandates that temporary or portable large gas turbines must follow federal permitting laws and emissions standards rather than local or state guidelines. This regulatory shift follows a 2024 review of hyperscale AI facilities that utilize truck-trailer-mounted methane gas turbines.

The ruling specifically impacts xAI's Colossus facilities in Memphis, Tennessee, which recently won a local permitting battle but must now adhere to federal standards. The Southern Environmental Law Center responded by calling on local health leaders to ensure federal law is followed to protect residents from air pollution.

These developments coincide with the rapid expansion of AI infrastructure across the U.S. In Port Washington, Wisconsin, city officials approved a multibillion-dollar Lighthouse campus for OpenAI's Stargate project despite local protests. Similar projects are expanding in Texas, Mississippi, and Oregon. While municipal leaders argue these centers boost local tax bases, critics and researchers warn of rising electricity costs, freshwater depletion, and public health burdens caused by the gas-powered turbines used to sustain high-compute AI models.
