Democrats Win Georgia Utility Board, Move to Limit Data Centers

Democrats secured a historic majority on the Georgia Public Service Commission and are partnering with Governor-elect Keisha Lance Bottoms to restrict data center expansion.

Democrats secured majority control of the Georgia Public Service Commission for the first time in 30 years following Tuesday's election. The new 3-2 majority, including Commissioner-elect Shelia Edwards, re-elected Commissioner Peter Hubbard, and Alicia Johnson, will take office in January to regulate Georgia Power and set residential electric rates.

Keisha Lance Bottoms, the Governor-elect of Georgia, intends to sign an executive order imposing a temporary moratorium on new data center approvals for one to six months. This pause aims to study the industry's impact on water usage, the electric grid, and utility costs. Simultaneously, the commission plans to open an affordability docket to ensure residential ratepayers do not subsidize infrastructure for large-scale data centers and to evaluate household payment capacities.

The political shift follows a multimillion-dollar campaign by environmental groups, including the Georgia Conservation Voters Education Fund, focused on rising electricity costs. Commissioner-elect Edwards also intends to halt utility disconnections during extreme weather. These state actions align with local efforts in Augusta, where officials recently passed an ordinance regulating data center noise and water use.

Georgia Power CEO Chris Womack maintains that data center revenue creates downward pressure to offset residential rate increases. However, the new commission majority has pledged closer scrutiny of the utility's long-term energy plans and a redacted contract with OpenAI, which critics argue lacks transparency.
