Meta Challenges Ofcom Over Online Safety Act Fee Calculations
Meta Platforms Inc. is suing UK regulator Ofcom in the High Court to contest the use of worldwide revenue to calculate regulatory fees and penalties.
Meta Platforms Inc. has launched a legal challenge in London's High Court against the UK media regulator Ofcom over the calculation of fees and penalties under the Online Safety Act. The company argues that Ofcom's use of qualifying worldwide revenue, rather than UK-specific revenue, to determine these costs is disproportionate and unlawful. Meta further disputes the methodology for calculating fines when multiple platforms under a single parent organization are found jointly liable.
Ofcom maintains that its framework is based on a plain reading of the law to ensure global platforms contribute proportionally to regulation costs. Despite the ongoing dispute, the regulator intends to issue invoices for fees in September and may be required to issue refunds if the legal challenge succeeds.
The High Court confirmed a preliminary hearing in June, with a full hearing expected in October. The Computer and Communications Industry Association (CCIA) and Epic Games are expected to seek permission to intervene in the case, with CCIA stating it intends to assist the court in understanding the broader impact on the technology sector.
