House Advances Crypto Tax Bill After Senate Regulatory Act Fails

The House Ways and Means Committee approved the Digital Asset Tax Certainty Act following the Senate's failure to pass a broader federal crypto regulatory framework.

The House Committee on Ways and Means advanced the Digital Asset Tax Certainty Act on Wednesday in a 38-5 bipartisan vote. The legislation aims to treat digital assets like traditional financial products and introduces a $10 de minimis exemption for small transactions to reduce compliance burdens for casual users. The bill also establishes tax rules for staking, mining, crypto lending, wash sales, and stablecoins.

This legislative progress follows the collapse of the Digital Asset Market Clarity Act in the Senate on Tuesday, which failed a cloture motion 49-50. Senator Cynthia Lummis attributed the failure to Democrats, claiming they shifted demands after the bill's supporters met previous requirements.

In response to the Senate's failure to create a new federal regulatory framework, the Securities and Exchange Commission and the Commodity Futures Trading Commission announced they will continue to oversee the industry using existing statutory authority. SEC Chair Paul Atkins stated the agency would act decisively to provide certainty for investors and entrepreneurs, while CFTC Chair Michael Selig affirmed that his agency is ready to implement rules for the digital finance sector.
