Assemblywoman Emily Gallagher urged New York City to stop jailing people for stealing basic hygiene products, sparking a backlash from police and city officials.
New York State Assemblywoman Emily Gallagher argued that jailing individuals for shoplifting basic hygiene products, such as soap and toothpaste, amounts to punishing people for meeting a biological need. Speaking at a news conference outside Manhattan Criminal Court alongside advocates from Court Watch NYC, Gallagher characterized these thefts as crimes of poverty and claimed the true crime is the extreme wealth disparity in New York City.
Gallagher urged Mayor Zohran Mamdani to abandon broken windows enforcement of low-level offenses, contending that the legal system prioritizes billion-dollar companies like CVS and Walgreens over struggling residents. She advocated for shifting investments toward housing, food assistance, and mental health treatment rather than incarceration.
Law enforcement and political critics rejected this stance. NYPD Chief of Detectives Robert Boyce warned that failing to make arrests would lead to chaos on the street, while Commissioner Jessica Tisch stated the department's mission is to ensure public safety and quality of life. Former Palm Beach County State Attorney Dave Aronberg added that while poverty explains crime, it is not a permission slip to steal.
Despite the debate, the New York City Police Department reported a decline in retail theft, with data showing a decrease of more than 14 percent compared to 2025. Some critics noted that toiletries are often stolen by organized retail rings for resale on digital marketplaces rather than for personal use.
