Local Governments Implement Data Center Moratoriums Across Three States

Local governments in three different regions implemented or extended moratoriums on data center developments on August 4, 2026, citing a need for better zoning and environmental protections.

In Maryland, the Federalsburg Town Council unanimously passed a three-year moratorium. The council rejected a request from property owner Sheldon Blumenfeld to delay the action pending a state report. Despite warnings from town attorney Lyndsey Ryan that a three-year pause could be viewed as an unconstitutional property taking, the council proceeded with the freeze and plans to consider a total ban on data centers during its August 17 meeting.

Meanwhile, the Vienna Township Board of Trustees in Ohio voted to extend an existing moratorium for an additional 60 days, moving the expiration date to October 16. The extension provides the Trumbull County Planning Commission more time to review proposed zoning language, which includes guidelines on sound levels.

In North Carolina, the Charlotte City Council is continuing a five-month moratorium that began in June. City officials are currently researching legal frameworks to protect land, air, and water resources. To refine these policies before the November 5 expiration, the city will appoint a community task force beginning August 13.
