Trump Administration Faces Lawsuits Over Detainee Transparency and Migrant Care
The Trump administration faces lawsuits over ICE transparency and criticism for detaining pregnant migrant youth in Texas shelters lacking specialized obstetric care.
The Trump administration is facing multiple legal and humanitarian challenges regarding the treatment of migrants and the transparency of federal enforcement agencies. In Tennessee, the American Immigration Council and the Tennessee Immigrant and Refugee Rights Coalition filed a lawsuit to uncover instructions from U.S. Immigration and Customs Enforcement (ICE) that allegedly discourage local law enforcement from releasing public records about immigration collaborations. Simultaneously, Greater Boston Legal Services filed a lawsuit in Boston to block an ICE policy that removes the locations of detainees with final deportation orders from the Online Detainee Locator System.
Separately, investigations revealed that the Office of Refugee Resettlement (ORR) has been detaining pregnant unaccompanied migrant youth in South Texas despite internal warnings about a lack of specialized obstetric care. While the Department of Health and Human Services (HHS) denies a blanket placement policy, records show that in July 2025, ORR directed staff to send all pregnant youth to a shelter in San Benito, later shifting placements to Los Fresnos.
Between July 2025 and May 2026, approximately 20% of pregnant girls in the region required out-of-state transfers to New York, California, or Arizona for critical care, including at least one abortion. Democratic members of Congress, including Representatives Joaquin Castro and Judy Chu, argue the policy is dangerous and may be intended to restrict reproductive healthcare. HHS maintains that placements are based on operational efficiency and child welfare best practices.
