British Father Appeals Swedish Deportation Order to Stay With Son
Simon Montgomery is appealing a Swedish court order to be deported, which would separate him from his 16-month-old son.
British photographer Simon Montgomery is appealing a deportation order from Sweden that would separate him from his 16-month-old son. The Swedish Migration Agency and a migration court rejected Montgomery's residency application, ruling that the state's interest in regulated immigration outweighs his interest in protecting his family life.
Authorities claimed Montgomery failed to demonstrate actual care for the child and argued he could maintain a relationship through visa-free visits. Montgomery, who moved to Sweden after Brexit, contends he has EU freedom of movement rights because his son is a German citizen through his mother.
Legal counsel for Montgomery asserts that the deportation would violate Article 8 of the European Convention of Human Rights and cause instability for the infant during a critical attachment phase. Montgomery has appealed the decision to a higher migration court.
