Judges Block Deportation of Kilmar Abrego Garcia to Liberia

Federal courts have intervened to halt the Trump administration's plan to deport Kilmar Abrego Garcia, a Salvadoran national and Maryland resident, to Liberia as early as October 31. The U.S. Department of Homeland Security designated Liberia as a thriving democracy and close partner that agreed to accept Garcia on a humanitarian and temporary basis. This follows failed attempts to deport him to Uganda, Eswatini, and Ghana, as well as a wrongful deportation to El Salvador in March 2025 that was later reversed by the Supreme Court.

In Maryland, U.S. District Judge Paula Xinis sought assurances that Garcia would not be removed while a court injunction remains in place, questioning why the government rejected Costa Rica as a viable refugee destination. Simultaneously, in Tennessee, U.S. District Judge Waverly Crenshaw threatened sanctions against Attorney General Pam Bondi and Homeland Security Secretary Kristi Noem. Judge Crenshaw ruled that their extrajudicial statements—which labeled Garcia an MS-13 gang member and child predator—were exaggerated or inaccurate and potentially prejudicial to his right to a fair trial.

Garcia, who has an American wife and child, has pleaded not guilty to federal human smuggling charges in Tennessee. His legal team argues that the prosecution is a form of vindictive retaliation for his constitutional challenges to his immigration status. Judge Crenshaw has ordered the government to produce internal communications to investigate these claims of retaliation, while the administration continues to fight subpoenas for high-ranking officials, including Deputy Attorney General Todd Blanche.
