First Nations Sue to Block Alberta Independence Referendum

The Sturgeon Lake Cree Nation and other First Nations filed for an injunction in the Alberta Court of King's Bench on April 7, 2026, to block a petition seeking Alberta's separation from Canada. The legal challenge targets the separatist group Stay Free Alberta, which claims to have collected over 177,000 signatures to force a provincewide referendum on October 19, 2026. The First Nations argue that the movement violates Treaty 8 rights and that the province failed to properly consult Indigenous communities.

The lawsuit also challenges Bill 14, a provincial law that lowered the signature threshold for citizen-led initiatives and removed the requirement for referendum questions to be constitutional. Chief Sheldon Sunshine characterized the process as a treaty violation, while legal counsel for the First Nations described the legislative changes as the legitimization of the tyranny of the minority. Additionally, the Sturgeon Lake Cree Nation raised concerns that the referendum would leave the province vulnerable to foreign interference.

Premier Danielle Smith has promised to add the independence question to the ballot if Elections Alberta verifies the signatures by May 2. The Government of Alberta defended the process in court, arguing that the petition is a neutral exercise of democratic expression and that claims of treaty damage or foreign interference are speculative. This case is the first of three planned challenges, with the Athabasca Chipewyan First Nation and the Blackfoot Confederacy expected to follow.
