Appeals Court Clears Way for Trump Administration Contempt Case

A federal appeals court denied a request to reconsider a previous decision, permitting Judge James Boasberg to proceed with contempt proceedings against the Trump administration. The legal conflict centers on the administration's March decision to deport hundreds of alleged gang members to the CECOT mega-prison in El Salvador using the Alien Enemies Act.

These deportations occurred despite a temporary restraining order issued by Boasberg, which specifically directed that the deportation flights be turned around. The Executive Branch argued that the Venezuelan gang Tren de Aragua constitutes a "hybrid criminal state" currently invading the United States. The United States Department of Justice further claimed that the oral instructions to return the flights were defective.

The appeals court described the administration's conduct as "shocking" and reaffirmed that judicial orders are binding commands. The proceedings were further prompted by whistleblower allegations claiming the administration deliberately planned to defy the court's order. The American Civil Liberties Union is challenging the deportations through attorney Lee Gelernt.
